ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy (“AUP”) governs how customers and users may access and use the RealBuilder Web software‑as‑a‑service platform and related services provided by Sixy Inc. (“RealBuilder Web,” “Sixy Inc.,” “we,” “us,” or “our”).
This AUP applies to all access and use of:
- The Platform (e.g., app.realbuilderweb.com and associated services);
- Any APIs, SDKs, or integrations we provide;
- Any website(s) you build and operate using the Platform (“Client Site(s)”).
By using the Platform, you agree to this AUP. Capitalized terms not defined here have the meanings in the Platform Terms of Service and Platform Privacy Policy.
1) Definitions
- Agent: The subscribing real estate professional (or their organization) operating a Client Site.
- Content: Any data, text, images, media, listings, AI prompts/outputs, or materials uploaded to or generated via the Platform.
- MLS®/VOW/IDX Data (“MLS Data”): Listing data and related materials provided by authorized boards (e.g., TRREB) and/or third‑party providers.
- User: Any person accessing the Platform or Client Site, including Agent staff and contractors.
2) Eligibility & General Obligations
- You must be 18+ and authorized to use the Platform on behalf of the Agent.
- You are responsible for all activity under your account(s), including activity by staff or contractors.
- You must keep credentials, API keys, and tokens confidential and secure.
3) Lawful, Respectful, and Compliant Use
When accessing or using the Platform and Client Sites, you must not:
A. Illegal, Harmful, or Abusive Activity
- Use the Platform for any unlawful purpose or in breach of applicable law or regulation.
- Upload, post, transmit, or store malware, viruses, or any code intended to disrupt or compromise systems.
- Engage in harassment, threats, hate speech, or other abusive behavior.
- Exploit or attempt to exploit security vulnerabilities without our prior written authorization (no penetration testing or scanning unless we approve in writing).
- Use the Platform for high‑risk activities where failure could result in death, personal injury, or severe environmental damage.
B. Intellectual Property & Content Rights
- Upload or distribute copyrighted or third‑party materials without permission.
- Misuse trademarks, including MLS®, Multiple Listing Service®, CREA, TRREB, or other board marks.
- Remove or obscure proprietary notices, watermarks, or required disclaimers.
C. Privacy, Data Protection & Communications
- Collect, process, or share personal information in violation of your Privacy Policy, the Platform Privacy Policy, or applicable laws (e.g., PIPEDA, GDPR/UK GDPR, CCPA/CPRA).
- Send unsolicited or unlawful marketing messages via email/SMS/DM. You must obtain valid consent and comply with CASL, CAN‑SPAM, TCPA, and similar laws.
- Use the Platform to process sensitive personal data unless permitted by law and necessary protections are in place (e.g., proper notices and consent).
D. Security & Network Integrity
- Attempt to bypass authentication, access accounts or data you do not own/control, or disable security controls.
- Overload, interfere with, or degrade the Platform or any third‑party services we integrate with.
- Share or resell access, or allow unauthorized parties to use your credentials or API keys.
E. Fair Use, Resource Abuse & Automation
- Use automated means (bots, scrapers, crawlers) to access the Platform or harvest data except through our documented APIs and within published rate limits.
- Engage in abusive consumption of bandwidth, storage, compute, or API calls. We may throttle, rate‑limit, or suspend access to ensure stability of the Platform.
4) MLS® / TRREB / VOW / IDX Compliance
If you enable MLS Data (e.g., via TRREB and authorized providers such as repliers.com):
- Follow all board rules, MLS® policies, and license terms, including display rules, attribution, and required trademarks and disclaimers on Client Sites.
- Place VOW data behind a user login/registration and collect only the information permitted by the applicable rules.
- Do not scrape, copy, download, redistribute, or resell MLS Data, nor allow third parties to do so.
- Ensure all MLS Data is used for consumer personal, non‑commercial use and is deemed reliable but not guaranteed.
- Remove or update MLS Data promptly when required by the board or data provider.
- You remain responsible for compliance with your board agreements and any client‑ or brokerage‑specific obligations.
5) AI‑Assisted Features
Where the Platform provides AI‑assisted content or valuation tools:
- Review and verify all AI outputs before publishing. AI outputs may be incomplete or inaccurate and are provided “as is.”
- Do not use AI outputs as legal, financial, or real estate advice.
- Do not use AI to generate misleading, discriminatory, or unlawful content, including content violating fair housing or human rights legislation.
- Do not provide AI with third‑party confidential or personal data unless you have a lawful basis and appropriate permissions.
- We may use third‑party AI providers; you must comply with their acceptable use rules and our Terms.
6) Third‑Party Services & Integrations
The Platform integrates with third‑party services (e.g., analytics, advertising pixels, CRMs, mapping, AI providers, listing providers). When enabling integrations:
- Ensure you have lawful rights and consents to share data with such providers.
- Use integrations only as permitted by their terms and policies.
- We may add, change, or remove integrations at any time and may suspend an integration for security, legal, or performance reasons.
7) Content Standards on Client Sites
Client Site content must be lawful, accurate, and non‑infringing. Prohibited content includes:
- Deceptive, fraudulent, or defamatory material;
- Illegal discrimination or violation of fair‑housing/human‑rights laws;
- Pornographic, exploitative, or age‑inappropriate material;
- Malware or code intended to track users without proper disclosure/consent;
- Personal information posted without proper authorization.
You (the Agent) are fully responsible for Client Site content, including property descriptions, images, blog posts, testimonials, and marketing materials.
8) Email, SMS, and Notifications
You must comply with anti‑spam and consent requirements (e.g., CASL, CAN‑SPAM, TCPA). At minimum:
- Obtain valid consent where required;
- Provide clear identification of sender;
- Include opt‑out mechanisms;
- Honor unsubscribe requests promptly.
9) API & Automation Rules
- Use only documented endpoints and supported SDKs.
- Respect the rate limits and usage thresholds published in the Platform or documentation.
- Do not attempt to circumvent rate limits or quota controls.
- We may monitor, throttle, or suspend API usage to preserve stability or for suspected abuse.
10) Security Responsibilities
- Implement reasonable safeguards on your devices, browsers, and networks.
- Use strong passwords and multi‑factor authentication where available.
- Limit access to authorized personnel and remove accounts that are no longer needed.
- Notify us without undue delay of any suspected compromise, credential leak, or unauthorized access.
11) Data Residency & Transfers
You acknowledge that Platform data may be processed in the United States and Canada.
Where applicable, international transfers will follow the safeguards described in the Platform Privacy Policy and DPA.
12) Enforcement, Suspension & Termination
We may investigate suspected violations of this AUP and may take any action we deem appropriate, including:
- Warning or requesting remediation;
- Throttling or rate‑limiting traffic;
- Disabling features or integrations;
- Suspending or terminating accounts or access;
- Removing content;
- Reporting unlawful activity to authorities.
We may take action without notice where required by law, regulatory request, urgent security risk, or MLS®/board directive.
13) Reporting Violations & Appeals
To report a suspected violation, security issue, or abusive behavior, contact:

If your access is suspended and you believe it was in error, you may appeal by emailing the same address with details supporting your position. We will review appeals in good faith but our decision is final.
14) Changes to this AUP
We may update this AUP from time to time. Material changes will be indicated by updating the “Last Updated” date and may be communicated via the Platform. Continued use after an update constitutes acceptance.
15) Governing Law
This AUP is governed by the laws of the Province of Ontario, Canada, without regard to conflict‑of‑law rules.
