TERMS OF SERVICE (TOS)

These Terms of Service (“Terms”) govern your access to and use of the RealBuilder Web platform, owned and operated by Sixy Inc., located at 557 Milwood Road, Toronto, Ontario, M4S 1K7 (“RealBuilder Web,” “Sixy Inc.,” “we,” “us,” or “our”).
By creating an account or using the RealBuilder Web platform (“Platform”), you agree to be legally bound by these Terms.

If you do not agree, you must discontinue use of the Platform immediately.

1. Eligibility

To use the Platform, you must:

Be a licensed real estate professional or authorized marketing/admin staff acting on their behalf;
Be at least 18 years of age;
Have authority to bind the entity or brokerage you represent;
Comply with all applicable real estate board rules, including MLS®/IDX/VOW rules.

2. Account Registration & Security

You agree to:

Provide accurate, complete, and current information when creating your account;
Maintain the confidentiality of your login credentials;
Accept responsibility for all activity occurring under your account;
Notify us immediately of unauthorized access or suspected security breaches.

3. Platform Services

RealBuilder Web provides a software-as-a-service platform enabling:

Website creation and hosting
CRM and lead capture tools
Property search integrations
Listing display via MLS®/VOW/IDX (where permitted)
Home‑evaluation tools
AI‑assisted content generation (current or future)
Analytics and marketing integrations
Vendor integrations and API‑based features

RealBuilder Web may modify, enhance, or discontinue features at any time.

4. License & Use of Platform

We grant you a limited, non‑exclusive, non‑transferable license to access and use the Platform during your subscription.

You may not:

Reverse engineer, scrape, or extract Platform data;
Misuse MLS® or listing data;
Attempt to circumvent security or rate limits;
Use the Platform in violation of law or board regulations;
Resell or sublicense the Platform without written authorization.

5. Content Ownership

a) Your Content

You retain ownership of:

Website content you upload
Branding and media assets
Lead and client data
Custom text, posts, and materials

You grant RealBuilder Web a license to host, display, process, and transmit your content solely to provide the Platform.

b) Platform Content

All Platform materials — including code, templates, themes, interfaces, designs, and documentation — are owned by Sixy Inc. and licensed for use under these Terms.

6. User Responsibilities

You agree that:

You alone are responsible for the accuracy, legality, and compliance of the content you publish;
You must comply with all real estate board rules;
You must ensure your public website displays all required disclaimers and MLS® notices.

7. MLS® / TRREB / CREA Rules

When using MLS®-related features or importing MLS® data:

You must maintain compliance with all TRREB/CREA rules;
You must display required trademarks and disclaimers;
VOW data must be behind registration and securely authenticated;
You may not scrape, copy, resell, or misuse MLS® data.

8. Prohibited Activities

You may not:

Use the Platform for unlawful purposes;
Upload harmful code or security‑compromising materials;
Use the Platform to harass or defraud users;
Misrepresent identity, licensing, or brokerage affiliation;
Interfere with network performance or Platform integrity.

9. Third‑Party Services

The Platform integrates with third‑party providers such as:

MLS®/listing services (e.g., repliers.com)
Marketing/advertising systems
Analytics tools
Mapping/location services
AI providers

We may add or remove integrations at any time without updating these Terms.

We are not responsible for:

Third‑party outages
Data inaccuracies
Changes to third‑party services
Disruptions caused by third‑party vendors

10. AI Features & Limitations

AI‑assisted content, suggestions, or valuations:

Are generated automatically
May use third‑party AI models
May contain inaccuracies
Must be independently reviewed before publishing
Do not constitute legal, financial, or real estate advice

You assume all responsibility for reviewing AI‑generated materials before use.

11. Fees & Billing

Subscription fees, billing intervals, and plan terms are displayed at checkout or within your account dashboard.

You authorize us to:

Charge recurring subscription fees
Suspend or terminate access if payment fails

Pricing and plan updates may occur at any time.

12. Termination

We may suspend or terminate your account if:

You violate these Terms;
You misuse MLS® data;
Required payments fail;
We are legally required to do so;
A real estate board mandates suspension due to compliance issues.

Upon termination:

Access to the Platform will be disabled;
Your hosted website may be removed;
Data will be handled in accordance with our Privacy Policy and DPA.

13. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind.
We do not guarantee:

Accuracy of MLS® or third‑party data;
Uptime or uninterrupted access;
Error‑free operation;
Accuracy of AI‑generated content.

14. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for indirect, incidental, or consequential damages;
Our total liability is limited to the amount paid in the last 12 months of your subscription.

15. Indemnification

You agree to indemnify Sixy Inc. and its affiliates against claims arising from:

Your use of the Platform
Your content
MLS®/board rule violations
Misuse of data or AI features

16. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict‑of‑law rules.

17. Changes to These Terms

We may update or modify these Terms from time to time.
Your continued use of the Platform constitutes acceptance of the updated Terms.
